Parking Lot Accident

Our clients, two young women, were seated in their parked vehicle at a convenience store when a large pick-up truck slammed into the rear driver’s side of their car with significant force. The impact was so severe that one of the passengers lost bladder control. At the time of the collision, their vehicle was completely stationary, and the engine had not even been started, as the driver had just returned from inside the store.

The driver of the pick-up truck initially admitted fault, apologized, and stated that he had not seen their vehicle. He provided his insurance information and assured them that everything would be taken care of. However, he later changed his story and provided false information to his insurance company, USAA, attempting to avoid responsibility for the crash.

Tragically, both clients were pregnant at the time of the accident, and one of them lost her baby. Medical records confirmed that both women suffered severe back pain and complications related to their pregnancies as a direct result of the collision.

Cases like this are particularly challenging because parking lot accidents are often dismissed as minor due to low speeds and minimal visible vehicle damage. Insurance adjusters frequently use this to argue that the injuries could not be serious. In addition, liability is often disputed, as parties commonly claim the other vehicle was moving. That tactic was used here when the pick-up driver changed his account of the incident.

Despite these significant challenges, attorney Chuck Martin was able to successfully negotiate substantial settlements for both clients.
