Our client, a woman in her seventies, was riding her bicycle in a designated bike lane when a driver in a large pick-up truck made a right turn from a cross street and struck her from behind, throwing her violently onto the pavement.
She was transported by ambulance to the emergency room, where she was diagnosed with four fractured ribs on her right side and a pneumohemothorax, or collapsed lung. Due to the severity of her pain, she was administered an epidural. A CT scan further revealed a massive rotator cuff tear in her right shoulder, while X-rays showed a detached tendon in her right elbow.
She remained hospitalized for six days before being transferred to a rehabilitation center, where she underwent both occupational and physical therapy for an additional six days. Upon discharge, she was instructed to continue home care and to keep her right arm immobilized in a sling.
Her recovery required ongoing treatment with an orthopedic specialist. She received epidural injections in her shoulder, and a subsequent MRI confirmed a large rotator cuff tear with associated muscle atrophy, tendinosis, and joint degeneration. She endured several months of intensive physical therapy and rehabilitation. As is common with this type of injury, she developed adhesive capsulitis, or “frozen shoulder,” requiring continued home exercise and stretching.
Given her age and the extent of her injuries, surgical repair of the rotator cuff was not considered a viable option. However, her orthopedist has advised that a total shoulder replacement may be necessary in the future due to her limited range of motion.
Before the accident, she led a highly active lifestyle, regularly golfing and biking with friends and participating in bowling during the winter months. These activities have been significantly curtailed due to her injuries and the long recovery process. In addition to her physical injuries, she developed symptoms of PTSD, anxiety, and depression, requiring ongoing therapy. She also required dental treatment for a cracked tooth and crown sustained in the accident.
Despite the severity and complexity of her injuries, MartinLaw PLLC successfully secured a substantial mid six-figure settlement for her within six months of the collision.
